Diversity finder: terms of use
The Diversity finder (hereinafter also referred to as the ‘Platform’) is service offered by Migros Culture Percentage. Migros Culture Percentage is part of the Migros Cooperative Alliance (MCA) (hereinafter also referred to collectively as ‘we’/‘us’), which claims all rights to the Diversity finder.
Scope
These Terms of Use apply to all functions available on the Diversity finder and to all activities and actions related to the Diversity finder of all persons who (a) visit the Diversity finder and/or send enquiries (hereinafter referred to as ‘users’), and (b) create a profile on the Diversity finder (hereinafter referred to as ‘experts’).Offer of the Diversity finder
The Diversity finder is aimed exclusively at people resident in Switzerland. The Diversity finder is intended to bring greater visibility to people with professional and biographical expertise in diversity issues. The Diversity finder aims to support associations, organisations, companies and public institutions in finding and involving experts in social and cultural issues who have diverse biographies and life realities.With the Diversity finder, Migros Culture Percentage provides a platform for profiles of various experts. The aim of the Diversity finder is to facilitate the search for people with professional and biographical expertise in diversity issues. The Diversity finder enables users to find various profiles on one platform in order to find suitable experts and contact them if necessary.
The Diversity finder is a free service offered by Migros Culture Percentage. Creating a profile, visiting the platform, searching for experts and using the contact form are free of charge.
We reserve the right to change or discontinue functions of the platform or the platform itself at any time and without prior notice. The platform may also be temporarily unavailable for various reasons.
Use of the Diversity finder and potential conclusion of a contract
Users can search the Diversity finder for experts using various filters (e.g. topics, languages, regions). Once a user has found a suitable profile, they can contact the respective expert using the contact details provided in the profile and/or via the contact form. The contact form contains a reCAPTCHA to prevent requests from bots.The first contact with an expert is free of charge. If the user wishes to enquire about hiring the expert for an assignment, any contractual relationship arises solely between these two parties. The user and expert jointly agree on the specific services and costs in each individual case (e.g. costs for a presentation or advisory services). Experts inform users transparently and early on when costs will be incurred. All matters relating to the relationship between the user and the expert (in particular, services received by users or payments to experts) must be addressed directly to the other party (user or expert).
Migros Culture Percentage only provides the platform with profiles and contact options. Under no circumstances does the use of the Diversity finder create a contractual relationship with Migros Culture Percentage or the MCA (neither with users nor experts). Migros Culture Percentage is not part of any agreements between users and experts, nor does Migros Culture Percentage have any influence on any agreements; in particular, Migros Culture Percentage does not make any recommendations regarding fees. Furthermore, we are not liable for the services of users and experts.
Expert profiles
Experts who keep a profile on the Diversity finder want to promote change, contribute their expertise and support interested users. Experts are aware that interested users are at different levels of engagement with diversity issues, and they know how to handle these differences.On their profile, experts only share information they want to share (much of the information is optional). They decide for themselves how they want to describe their expertise and their biographical experiences. Third-party advertising on profiles is not desired, but a link to your own website or organisation is possible. We recommend that you use the contact form to get in touch with us. Experts can also list their own contact options. You can only create one profile; the diversity finder does not allow multiple accounts.
Experts are solely liable for the content of their profile and for content to which they refer in their profile (e.g. content of their own linked website). Experts undertake to provide all information about themselves truthfully. Migros Culture Percentage is not liable for information and content in the profiles of experts or for content linked there (in particular not for its accuracy or completeness).
We are authorised (but not obliged) to review or check information provided by experts on or via the platform. We are authorised, but not obliged, to take appropriate measures at our sole discretion (e.g. refusal to activate a profile / deletion of the profile).
- Enquiries to experts
Users must note the following when making enquiries to experts:- Truthful information: users undertake to provide up-to-date, accurate, complete and truthful information about themselves.
- Specific request: Users describe exactly what they want to implement. This allows the experts to form an opinion and decide whether and how a collaboration is possible.
- No copy-paste messages: users refrain from sending the same message to several experts at the same time. Users specifically request experts who are suitable for their projects. They also approach the matter with a willingness to engage with the selected diversity topics in a sustainable manner.
- No claim to acceptance of an enquiry: The experts decide for themselves whether to accept or reject an enquiry via the Diversity finder. They can reject requests at any time, e.g., if they already have too many requests or assignments or if they have the impression that users are not seriously willing to change.
- No inappropriate messages: Users must comply with these terms of use, in particular, the rules of conduct (section 7 below). If users send inappropriate requests, experts may refuse to respond to their message, report them to us as a user, block them and/or take further action.
- Interacting with other users and experts
Users and experts are solely responsible for their dealings with other users and experts. We do not review the communication between users and experts, even if they are sent via the Diversity finder contact form. We are not liable for the online or offline behaviour of any users or experts. In particular, we are not liable for their statements (e.g. in contact forms), behaviour, communication, their handling of data of the other person or for information/materials provided by them.
- Rules of conduct for users and experts
Users and experts guarantee that they will use the Diversity finder in a considerate and compliant manner. This means, in particular:- No unlawful or discriminatory communication: Migros Culture Percentage is committed to ensuring that everyone respects each other. The following will not be tolerated: discrimination, personal attacks, disrespectful comments, provocations and content that violates legal provisions or social norms. This includes offensive, hurtful, sexist, racist, ableist and otherwise discriminatory content.
- Careful and confidential handling of personal data.
- Respect boundaries: In their profile, experts only share the personal information they wish to share publicly. Users respect these boundaries. If they have any queries, they focus on questions relating to professional or practical experience that are relevant to their project.
- No spam/phishing: The sending of spam or phishing messages is not permitted (e.g. links to malware, etc.).
- No improper use of contact information: The use of email addresses or contact information of other users or experts from the platform for the purpose of sending unsolicited emails or other unsolicited communication, in particular through telemarketing or other telephone contact, is not permitted.
- No misuse of content: The misuse of content from the Diversity finder is not permitted.
- Data protection for experts
- a) Privacy policy
The protection of personal data is our top priority. Migros Culture Percentage is a Migros Group company. The processing of personal data in connection with Migros Culture Percentage is subject to the Migros Group Privacy Policy, available at privacy.migros.ch. - b) Purpose limitation
The data collected as part of the Diversity finder may only be used for the operation of the Diversity finder by Migros Culture Percentage (in the Social Affairs and Culture Directorate of the Migros Cooperative). We do not share the data for marketing purposes within the Migros Group (Migros-Login, Cumulus). - c) Confidentiality
The data provided will be treated confidentially and can only be viewed by the project team. Only the information provided and labelled as public is published on the Migros Culture Percentage Diversity finder. - d) Data autonomy
Experts decide for themselves which data they want to collect during Login and share publicly in their profile. e) Changes, deactivation or deletion requests
Experts can get in touch with the contact person at Migros Culture Percentage at any time if they wish to make an adjustment, temporarily deactivate their profile or delete their profile. We will remove it from the platform as soon as possible. Your data will be deleted in full if you cancel your profile.
- a) Privacy policy
Violations of the Terms and Conditions
We endeavour to prevent misuse of our platform by users or experts, but we cannot rule this out. Any liability on our part is excluded.If we become aware of violations of the present Terms and Conditions of Use, we are authorised, but not obliged, to take such measures as we deem reasonable and appropriate in our sole discretion. In particular, we reserve the right to remove experts’ profiles from the platform at any time without prior notice and without giving reasons and/or to block users from any future use of the platform.

To the extent permitted by law, the websites and all information, content, products and services contained or otherwise made available on them are provided without any representations, warranties or guarantees of any kind. In particular, the availability of the websites, their use and the backup or archiving of the transmitted data are not guaranteed.We exclude any liability, including negligence, to the extent permitted by law.
